Shit. Normally no. There would have to be a system in place to check court record to find out if said woman was ACTUALLY raped or not. (This would be far too complicated and bureaucratic, and this system would most likely never work.)

There's a verse in Ezekiel that comes to mind, but this verse also, ironically, objects to the point you're making.
